On August 23, 2017, David Bradley Hughes (“Petitioner”) was placed into the custody of the U.S. Marshals and charged with one count of Conspiracy to Possess with Intent to Distribute a Controlled Substance. On September 26, 2017, the Petitioner plead guilty to a single count of conspiracy to possess with intent to distribute a controlled substance, per 21 U.S.C. §§ 846, 841(a)(1) and (b)(1)(B). Because This interlocutory appeal arises out of property damage that resulted from an explosion at a natural gas compression station. The station owner, Crosstex Energy Services, L.P., sued the leadconstruction contractor, Pro Plus, Inc. The parties then entered a Rule 11 agreement to move expert designation dates beyond the limitations period. After limitations ran, Pro Plus moved to dismiss because Crosstex had not filed a certificate of merit with its original petition as required by section 150.002 of the Texas Civil Practice and Remedies Code.

The Texas Emissions Reduction Plan (“TERP”) was established by the 77th Texas Legislature in 2001 through enactment of Senate Bill 5. TERP includes a number of financial incentive plans intended to address the goals of the plan to reduce emissions. As part of these programs, TCEQ provides money or rebates to people to incentive them to purchase and replace certain vehicles, primarily trucks in high population areas, with lower emission vehicles in certain counties in the State. Since the beginning of the program in 2001 through September 2008, the TCEQ has awarded grants of over 700 million dollars. Id. Presumably millions more in state taxpayer funds have been awarded since 2008.

In early 2009, the Damuth became aware of an opening for the Head Women’s Basketball Coach position at TVCC. Damuth filed his application for the position and was interviewed by a search committee appointed by TVCC’s governing board. After the selection process was complete, the search committee unanimously recommended Damuth be hired as the new Women’s Head Basketball Coach. Based upon this recommendation, TVCC offered Damuth the position as head coach. On September 1, 2009, Damuth in good faith reliance on these representations, accepted TVCC’s employment offer and entered into a written agreement termed “Professional Services Contract”.
